Obstruction of a Highway-Intoxication Charges
Facing DWI Charges in San Antonio? I, Attorney Roberto Ambrosino, Can Help!
When San Antonians are arrested for their first DWI, they are usually charged with two crimes: DWI and the lesser crime of Obstruction of a Highway. In certain situations, those facing DWI charges in San Antonio, Texas may be able to have their charges reduced to the Obstruction of a Highway charge. This option, commonly called the “Taking Responsibility Program”, can significantly reduce the severity of the DWI charge and resulting penalties for first-time offenders.
As a San Antonio DWI attorney with nearly a decade of experience, I have the legal skills necessary to protect your rights and future. I work with you to craft a legal strategy that addresses your charges that best fits your specific needs.
Who Qualifies for an Obstruction of a Highway Charge?
As a Class B misdemeanor, an Obstruction of a Highway charge can serve as an alternative for those facing DWI charges in the San Antonio area. Not every person who was arrested for a DWI may qualify for this reduction; in fact, many do not.
In order to be eligible for the Obstruction of a Highway in lieu of a DWI, the following criteria must be met:
- The driver must not have any previous DWI convictions
- The driver’s BAC must have been under 0.15%
- The driver’s intoxication must not have caused any accidents or injuries
- The plea must be made within 90 days of the initial arrest
Advantages of Pleading Guilty to Obstruction of a Highway
If the defendant meets all of these criteria, he or she may accept a Obstruction of a Highway charge instead of facing the more severe consequences of a DWI conviction. The defendant may also later apply for non-disclosure, which would effectively seal the case from public view. While these charges may still result in fines, classes, community service, and alcohol monitoring, the repercussions will be drastically less serious and are far less likely to affect employment or housing opportunities, especially if a non-disclosure is later proved.
