The Right to Expunction

The right to expunction is upheld under Article 55.01 of the Texas Code of Criminal Procedure. If you have been acquitted by a trial, pardoned, or your case dismissed, you may be eligible. Many prior juvenile cases can also be expunged. However, not everyone who has a criminal record may be eligible for an Expunction.

Some important notes about expunctions:

  • If you were acquitted in a trial by a jury or judge, you are eligible for an Expunction.
  • There is a minimum 6-month waiting period (and may last up to several years) before you are eligible to expunge prior criminal offenses.
  • The exception to the above is if a prosecutor dismissed the case for lack of probable cause, false information, or mistake at the time of arrest.
  • If you were convicted of a crime and sent to jail, prison, or probation, then you may not be eligible for Expunction.
  • You may be eligible for a non-disclosure if your case was not dismissed or you were not acquitted by a jury.

An expunction suit is filed in a civil district court in San Antonio, Texas, separate from the criminal action, requiring separate filing fees to be paid to the court. An expunction is a court order to the world to destroy any record of the arrest or the criminal case that they have in their possession. Once the judge signs the expunction order, the order is sent certified mail to any government agency you believe may be in possession of your criminal record.
