Clearing Your Criminal Record

Like an expunction, there is usually a waiting period, ranging from two to five years from the date your case was dismissed to obtain a non-disclosure. A non-disclosure seals your criminal record for a particular case, making it only visible by certain government agencies, and will not appear in most private criminal background checks.
Those Able to Still View Non-Disclosed Crimes
A criminal justice agency may disclose criminal history record information over a non-disclosure to the following agencies, including but not limited to:
- The State Board for Educator Certification
- Any school district
- The Texas State Board of Medical Examiners
- The State Bar of Texas
- The Department of Family and Protective Services (CPS)
- The Board of Nurse Examiners, a hospital, fire department
- The Texas Health and Human Services Commission
Crimes That Are Not Eligible for Non-Disclosure
Unfortunately, some crimes are not able to be non-disclosed, even if you did receive deferred adjudication and completed it successfully. Under Section 411.08 of the Texas Government Code, a person is not eligible for a non-disclosure if the person has been previously convicted or placed on deferred adjudication for:
- Indecency with a Child
- Sexual Assault
- Aggravated Sexual Assault
- Prohibited Sexual Conduct
- Aggravated Kidnapping
- Burglary of a Habitation with intent to commit any of the above offenses
- Compelling Prostitution
- Sexual Performance by a Child
- Child Pornography
- Unlawful Restraint, Kidnapping, or Aggravated Kidnapping of a person younger than 17
- Attempt, Conspiracy, or Solicitation to commit any of the above offenses
- Capital Murder
- Murder
- Injury to a Child or Elderly
- Abandoning or Endangering a Child
- Violation of a Protective Order
- Stalking; or
- Family Violence offenses.
